Terms and Conditions

In short. This summary doesn't replace the full text, but it covers the essentials:

  • Aros is free and has no ads.
  • What you create in the app is yours. We only use it to make the app work.
  • Aros helps you with your habits, but it isn't a medical service and doesn't give medical advice.
  • Reminders depend on your phone and sometimes may not arrive: don't rely on them alone for anything important.
  • In pacts, the people you share a habit with see your name and your progress on that habit. Treat them with respect.
  • You can delete your account whenever you want, from the app.
  • Colombian law applies, but you keep the rights the law of your country gives you.

1. Who provides the service

Aros is a habits and reminders app for iPhone and Android, together with this website (together, “Aros” or “the service”). It is developed and provided by Pablo Chaves, an individual based in Bogotá, Colombia (“we” or “us”). You can write to us about anything at aros.habitapp@gmail.com.

2. Accepting these terms

These terms are the agreement between you and us for using Aros. When you create your account, the app shows you a notice with links to these terms and to the Privacy Policy: by continuing, you accept both. The Privacy Policy explains what data we collect and how we handle it; it is part of this agreement. If you don't agree with them, don't create an account or use Aros.

3. Minimum age

To use Aros you must be at least 13 years old, or 16 if you live in the European Union, the European Economic Area or the United Kingdom. If the law of your country sets a higher age to use a service like this on your own, that age applies. We ask for your date of birth when you create your account to check this.

If you are not an adult in your country, you need permission from your parent or guardian, who should read these terms with you. If we learn that an account belongs to someone below the minimum age, we will close it and delete their data.

4. Your account

  • You can create your account with your email and a password, or sign in with Google or Apple.
  • Your account is personal: one person per account. Don't share it or use someone else's.
  • Use accurate information in your profile and keep it up to date.
  • Look after your password and access to your phone. If you think someone has got into your account, change your password and write to us.

5. Licence to use the app

We give you permission to use Aros on devices you control, for your personal, non-commercial use. It is a free, non-exclusive, non-transferable permission that lasts as long as you use the app in line with these terms. You may not copy, modify, sell or redistribute the app, or try to access its code or our servers other than through the app itself, except to the extent the law expressly allows you to.

6. Your content

“Your content” is everything you create or upload to Aros: your habits, tasks, notes, check-ins, your name and your profile photo. Your content is yours. For the app to work we need to store it, sync it across your devices, back it up and, in pacts, show what is needed to the people you share a habit with. For that you give us a free, worldwide, non-exclusive permission, limited to providing the service to you. We don't use your content for advertising and we don't sell it. The permission ends when you delete that content or your account, except as explained in section 7 about pacts.

You are responsible for having the right to use what you upload, such as your profile photo. What you write in titles and notes is free text: we recommend not including particularly sensitive information, such as health data.

7. Pacts (shared habits)

A pact is a habit you share with other people who use Aros. When you join a pact:

  • The other people in the pact see your name and your progress on that habit, such as the days you complete it and the joint streak. They don't see your other habits, your tasks or your notes.
  • A pact's schedule is shared by everyone and can't be changed individually.
  • You can leave a pact whenever you want.
  • If you delete your account, you leave all your pacts. The other people keep their own history and the joint streak up to that day, but your name is replaced with “Deleted participant”.

Only join pacts with people you know and trust, and follow the rules in the next section.

8. Rules of use

When using Aros, and especially in pacts, you must not:

  • harass, threaten, insult or intimidate other people, or incite hatred or violence;
  • post sexual, violent or illegal content, or content that puts minors at risk;
  • impersonate someone else or use someone's name or photo without their permission;
  • use Aros to send advertising, spam or scams;
  • upload content that infringes copyright, trademarks or other people's rights;
  • try to harm, overload or get around the security of the app or our servers, or access them in an automated way;
  • use Aros for any illegal purpose.

9. Reports and moderation

If you see something on Aros that breaks these rules or the law, let us know by writing to aros.habitapp@gmail.com with what you saw, who posted it and in which pact. If the app offers an option to report or block someone, you can use it too. Reports are reviewed by a person.

If we confirm that some content or behaviour breaks these terms or the law, we may remove that content, remove a person from a pact, or suspend or close their account, in proportion to how serious the case is. Unless the law prevents it or there is a risk to other people, we will explain what we decided and why, and you can reply by writing to us if you disagree: we will review the decision again. We don't check what you write in the app in advance.

If you believe something posted on Aros infringes your copyright, write to us with the work concerned, where it appears, your contact details and a statement that the information is accurate and that you are the owner or are acting on their behalf.

10. Health and wellbeing

Aros is a tool for organising habits and tasks. It is not a medical device or a health service, and nothing it shows (streaks, stats, suggestions or habit templates such as exercising, sleeping or drinking water) is medical advice, diagnosis or treatment. Before starting a habit that affects your health, such as an exercise routine or a change in diet or sleep, consult a professional if you have any doubts. Don't use Aros in an emergency: call your local emergency services.

11. Reminders and notifications

Aros's reminders are scheduled on your own phone as notifications. Whether they arrive on time depends on the system and how you have set it up: notification permissions, battery saving, Focus or Do Not Disturb modes, the phone's clock, or the system closing the app can delay or prevent them. We do our best for them to work, but we can't guarantee that every reminder will arrive. Don't use Aros as your only reminder for anything important, such as taking medication, a medical appointment or any safety matter.

12. Availability and changes to the app

We want Aros to work all the time, but there may be interruptions for maintenance, bugs or problems with the providers it relies on. The app will change over time: we may add, improve or remove features to make it better, fix bugs, keep it secure or comply with the law. If a change significantly affects you, we will let you know reasonably in advance. Some features may be marked as experimental: they may fail more often or disappear.

If we ever decide to shut Aros down, we will give you at least 30 days' notice and a way to request a copy of your data before it closes.

13. Your data

Your data is stored in the cloud so it syncs across your devices. How we handle it, how long we keep it and what your rights are is explained in the Privacy Policy. You can request a copy of your data by writing to aros.habitapp@gmail.com. If you delete your account, your data is erased and can't be recovered.

14. Price

Aros is free and shows no ads. If we offer paid features in the future, they will be optional, we will explain their price and conditions beforehand, and you will have to accept them expressly. What is free in the app today won't become paid without your acceptance.

15. Third-party services and app stores

Aros relies on services from other companies, such as Google Firebase to store and sync data and Amazon Web Services to send your account emails. If you sign in with Google or Apple, their terms also apply to that sign-in.

You download Aros from Apple's App Store or from Google Play, and those stores have their own terms. On iPhone, Apple's standard licence agreement also applies. This agreement is between you and us, not with Apple or Google, who are not responsible for the app or its support. If these terms conflict with those terms, what these terms say about the service and your account prevails to the extent the law allows.

16. Intellectual property

The app, its design, its code, and the Aros name and logo belong to us or are used with permission. These terms give you no rights over them, except the right to use the app under section 5. If you send us suggestions or ideas, we may use them to improve Aros without any obligation to pay you for them.

17. Warranties

Aros is a free app provided as it is at any given time. We work to make it run well and securely, but we can't guarantee that it will never fail, be free of errors or serve a particular purpose of yours. Nothing in this section limits any warranties that the law of your country gives you and that cannot be excluded.

18. Liability

To the extent permitted by law, we are not liable for indirect or unforeseeable damage, for loss of data not caused by our fault, or for damage caused by third-party services, by misuse of the app or by reminders that didn't arrive for the reasons in section 11. To the extent permitted by law, our total liability to you for any matter related to Aros, which is free, will not exceed 50 US dollars.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, wilful misconduct or gross negligence, or any other liability that the law of your country does not allow to be excluded or limited. Nor does it limit the rights you have as a consumer under the law of your country.

19. Suspension, closure and deletion of your account

You can stop using Aros and delete your account whenever you want, from the app, under Profile → Delete account, or by following the steps on the Delete your account page. Deletion is immediate and can't be undone.

We may only suspend or close your account if you seriously or repeatedly break these terms, if the law or an authority requires it, if it is necessary to protect other people or the security of the service, or if you are below the minimum age. Except in an emergency or where the law prevents it, we will warn you first, explain why and let you respond. If we shut down Aros entirely, section 12 applies.

When the account is closed, this agreement ends, but the sections that by their nature should continue, such as intellectual property, liability and governing law, remain in effect.

20. Changes to these terms

We may update these terms to reflect changes in the app, in the law or in how we provide the service. When a change is significant, we will let you know in the app or by email at least 30 days before it takes effect, unless the law requires us to do so sooner. If you don't agree, you can delete your account before that date, at no cost, and ask us for a copy of your data. Changes don't apply to anything that happened before they take effect. You will always find the current version and its date here.

21. Governing law, complaints and courts

If you have a problem, write to us first at aros.habitapp@gmail.com: we will confirm we received it and try to resolve it within 30 days at most. This doesn't stop you from going to an authority or a court at any time.

These terms are governed by the law of Colombia. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country's law, and you can bring a claim before the courts and consumer authorities where you live. The courts of Bogotá, Colombia, also have jurisdiction. In Colombia, you can also go to the Superintendencia de Industria y Comercio. If you live in Brazil, you can go to the courts of your home in Brazil. There is no mandatory arbitration and no waiver of class actions.

22. Languages

We publish these terms in Spanish, English, French and German. All versions have the same value. If there are differences between them, the interpretation most favourable to you will apply.

23. Notices for some countries

  • Australia: nothing in these terms excludes, restricts or modifies the rights and guarantees you have under the Australian Consumer Law.
  • California (US): under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
  • European Union and United Kingdom: if a section of these terms conflicts with a consumer protection rule of your country, that rule applies instead.

24. Other provisions

  • If any section of these terms is not valid, the rest remains in force.
  • If we don't enforce a section at a given time, that doesn't mean we waive it.
  • We may transfer this agreement to a company we set up to run Aros or to whoever acquires the app, provided your rights are not reduced. We will let you know if that happens. You may not transfer your account.
  • We are not liable for failures caused by events beyond our reasonable control, such as general outages of the internet or of the providers in section 15, disasters or decisions by authorities.
  • These terms and the Privacy Policy are the entire agreement between you and us about Aros.
